Trade mark searching

Searching before you apply to register or use your trade mark achieves two major purposes:

  1. to determine if your proposed trade mark will be able to be registered in light of the marks that are already on the register or in use, and
  2. to determine if use of your proposed mark will infringe anyone else’s trade mark.

Before you spend any money on printing, packaging, labels etc., it is best to have a professional search carried out.  Proper searching before you launch is much cheaper than having to rebrand later.

Although it is possible for you to carry out your own trade mark search through word marks on the online trade marks registers, please bear in mind that trade mark searching is a difficult job and should be carried out by a trained trade marks searcher.
